What you can rent in Marbella and the Costa del Sol
Two markets share this page. Long term rentals are homes on twelve month and longer contracts, priced per month, furnished or unfurnished; most of that supply is in Nueva Andalucía, the golf valley and the Golden Mile, with family villas in Nagüeles, Sierra Blanca and the Estepona hills. Holiday rentals are licensed villas and apartments priced per week: private pools in the hills, beachside apartments in Puerto Banús and along the New Golden Mile. Long term or holiday: the rules that matter
Long term tenancies in Spain sit under the LAU, the national tenancy law. The tenant may stay for five years (seven if the landlord is a company) whatever the contract says, the deposit is one month by law, and since the 2023 Housing Law the agency fee is paid by the landlord, not the tenant. Andalucía has declared no “tensioned” areas, so there is no rent cap in Marbella; annual updates follow the national reference index published by INE.
Holiday lets need the Andalucía tourist licence (the VFT registration) and, since 1 July 2025, the national short term rental registration number shown in every advert. Communities of owners can restrict holiday letting in their statutes, so on any apartment we check the community rules before we list it. Our note on the short term rental rules sets out the detail.
Where to rent on the Costa del Sol
The same geography that decides sale prices decides rents. Walking distance to the beach, the schools and the town carries a premium; the golf valley and the hills give more house for the money and quieter nights. How we work with tenants and landlords
For tenants we do the searching, including homes that never reach the portals, check that the property is licensed and the landlord is who they say they are, and negotiate the contract. For landlords we value the property against what has actually been let rather than what is being asked, market it, vet the tenant properly, draft the contract to the LAU and lodge the deposit with the Junta as the law requires. Questions tenants and landlords ask us
How long is a long term rental contract in Spain?
Contracts are usually signed for twelve months, but the law gives the tenant the right to extend year by year up to five years, or seven if the landlord is a company. Either side can end it after that with the notice the contract sets out. Holiday lets sit outside this regime entirely.
What do tenants pay up front?
The first month, a legal deposit of one month, and often an additional guarantee of up to two months on higher value homes. Since the 2023 Housing Law the agency fee on a long term let is the landlord’s cost, not the tenant’s.
Can I let my Marbella property to holidaymakers?
Yes, once it holds the Andalucía tourist licence and the national short term rental registration number, and provided the community of owners has not restricted holiday letting in its statutes. We check both before we take a property on, and we handle the registration for you.
Are rents capped in Marbella?
No. Rent caps only apply in areas a regional government has declared “tensioned”, and Andalucía has declared none. Rents are set by the market; annual increases on an existing contract follow the national reference index published by INE.
